When using artificial intelligence to generate idea prompts, it’s important to provide AI tools with a clear subject, context, audience, tone, and perspective. While there are currently (as of December 2025) no official regulatory frameworks in Canada specific to AI, it is highly encouraged by the Government of Canada that businesses communicate when and where AI has been involved in tasks such as writing emails, generating images or videos, writing code, and much more. It’s best that those who are using AI for their website and marketing materials get used to disclosing this now, as there are sure to be laws passed in the future to ensure safety, transparency and accountability. 

Besides the legality of it, what might be even more important is the way it may impact your audience's view of your business. While AI might help with workflows,  complete tedious tasks, and speed up manual processes, your customers might feel deceived or lied to (and question the authenticity of your business) if AI-generated content is not clearly disclosed. 

When should I use an AI Disclaimer?

You have to decide for yourself and your business when and where to disclose the use of AI, since there are currently no strict regulations. While minor enhancements may not require explicit labelling of AI-generated content, it is recommended that very clearly manipulated imagery used in your advertisements, AI-generated videos on your social media or chatbots on your website, to give a few examples, should most certainly be disclosed to ensure there is no confusion or distrust sown. Here’s a breakdown:

Social Media

It is recommended that you disclose AI-generated content in the caption of any posts using AI in the following instances:

  • Any and all posts that feature either heavily AI-edited or generated imagery within reason. If you use AI for small touchups or to expand a real image to fit a certain size, disclosure is not explicitly needed. Use your discretion.  

  • AI-generated videos should always be disclosed to maintain transparency.

  • AI-generated copy (like your captions and comments) should also be disclosed.

Your Website

Add a disclaimer to your website footer and terms and conditions page if you use any AI-generated:

  • Copy on any of your webpages

  • Images or videos on any of your webpages

  • Products (such as print or artistic materials)

  • Use an AI chatbot assistant

    • If you can, disclose this in the chat box itself so it is obvious to your web visitors when they begin a conversation.

Other Marketing Materials and Communications that Feature AI content:

  • In emails, add a disclaimer in your email signature or footnote of the email content so your recipients can be aware that you may be using an AI assistant to either send communications for you or to help you with writing responses.

  • For Advertisements and campaigns with AI-generated content, either add a small disclaimer in the footnote of the advertisement itself or include one in your press release 

  • Restaurant Menus or product images that are either heavily edited or completely AI-generated should always have a disclaimer to avoid misleading your clients.
